Extension of Time

It is a common misconception that contractual extension of time mechanisms are solely for the benefit of the contractor. Indeed, ensuring that the completion date is extended to avoid exposure to delay damages is important for the contractor. However, what is not commonly understood is that the same mechanism is equally important for the employer.
If a change for which the employer is culpable makes it impossible for the contractor to achieve the completion date, then time for completion will become “at large” and the employer will be unable to claim delay damages. This applies equally to sectional completion and final completion dates.
